The Lane Field project sits on public trust lands and must therefore meet the conditions of the Public Trust Doctrine and the Coastal Act. For example, the Coastal Act clearly states that development in the coastal zone must include an adequate supply of affordable visitor-serving accommodations.
The State Lands Commission has already sent the Port two letters expressing concerns about the project – one about the more than 80,000 square ft. of retail space to be included in the project, the other about a proposed spa at Lane Field.
Both the retail and spa components must be consistent with the Public Trust Doctrine. The State Lands Commission has adopted a Public Trust Policy which states: “uses that do not accommodate, promote, foster or enhance the statewide public’s need for essential commercial services or their enjoyment of tidelands are not appropriate uses for public trust lands.”
